In a personal injury case, one of the most prominent factors that impact your claim is the severity of your injuries and the amount of damage it causes in your life. The insurance companies consider the expenses you bared for the medical treatment for your injuries, and everything else is secondary.

Your injuries come under special medical damages, a common term used by insurance companies to prioritize your injuries in a personal injury lawsuit. Now the challenging part is how you determine the estimate of the money you should receive for your claim.

In such situations, it is best to hire a Roseville personal injury lawyer as they will consider every aspect of your case and estimate how much money you deserve for your injuries.

Once you know the estimated amount, you can negotiate with the insurance company or the at-fault party at the time of settlement.

Nevertheless, here are common injuries in a personal injury case and how severe they are, according to the insurance company.

    Soft tissue injuries

Soft tissue injuries are injuries that cause damage to the soft parts of your body like muscles, ligaments, tendons, and other soft connective tissues. In most soft tissue injury cases, the primary evidence of pain and suffering is the patient’s description, as these injuries do not have prominent external bruises or discoloration.

The insurance company considers these injuries minor or less severe because, in most cases, soft tissue injuries heal with time. However, the insurance company has little or no concern about the excruciating pain these injuries can cause. They are not worried if the victim goes to court as it is difficult to prove these injuries in court.

    Hard tissue injuries

A hard tissue injury is much more severe and is compensated heavily, almost four or five times higher than other cases. In complex tissue injury cases, the damages are usually proved by a medical examination, X-ray, or official medical record.

So to prove a hard tissue injury claim, you must have strong evidence in your medical reports suggesting an internal tissue injury or external injury that requires immediate treatment. For example, a tissue rupture stitches your body to treat deep wounds, joint failure, etc.

    Example of Hard tissue injury

    • Fractures

Fractures or broken bones resulting in an X-ray are prevalent hard tissue injuries sustained in an accident. The more your injury impacts your life, the more compensation you can demand from the insurance company.

    • Brain injuries

Head or brain injuries can adversely affect a person’s health and life. While some of the symptoms and sufferings might be short-term, others can be long-lasting. In case of a brain injury, you can demand higher compensation considering post-treatment and work-life disruption in the future.
